In a significant step toward structured IP governance in wartime procurement, Ukraine’s Cabinet of Ministers approved a formal Policy on the Management of Intellectual Property in the Defence-Industrial Complex on April 10, 2026. The framework applies primarily to state customers and state-sector entities, while also extending obligations to private businesses operating in military and dual-use markets — requiring that their contracts comply with IP legislation and address licensing, enforcement, and rights registration. CMS notes that while the Policy introduces greater legal certainty and a unified information system for R&D and defence technologies, key implementation details — including access rules for private businesses — remain subject to follow-on regulation by the Ministry of Defence of Ukraine.
